41.477. Missouri National Guard counterdrug revolving fund — use of moneys. — 1. There is hereby created in the state treasury the "Missouri National Guard Counterdrug Revolving Fund", which shall consist of all moneys received by the Missouri National Guard through federal asset forfeiture programs, including, but not limited to, the United States Department of Justice Asset Forfeiture Program, the United States Department of the Treasury Asset Forfeiture Program, and any successor programs or funds established by the federal government for the distribution of seized or forfeited assets. The Missouri National Guard counterdrug revolving fund shall be administered by the adjutant general. The state treasurer shall be custodian of the Missouri National Guard counterdrug revolving fund. In accordance with sections 30.170 and 30.180, the state treasurer may approve disbursements. The Missouri National Guard counterdrug revolving fund shall be a dedicated fund and moneys in the fund shall be used by the adjutant general solely for purposes authorized by the federal programs from which the moneys originated. Moneys in the Missouri National Guard counterdrug revolving fund shall not be utilized to supplant, decrease, or otherwise diminish any state appropriations or allocations otherwise provided for the Missouri National Guard's standard operations, personnel, or infrastructure. Notwithstanding the provisions of section 33.080 to the contrary, moneys remaining in the Missouri National Guard counterdrug revolving fund at the end of any biennium shall not revert to the credit of the general revenue fund. The state treasurer shall invest moneys in the Missouri National Guard counterdrug revolving fund in the same manner as other funds are invested. Any interest and moneys earned on such investments shall be credited to the Missouri National Guard counterdrug revolving fund.
2. Participation in federal asset forfeiture programs shall be at the discretion of the adjutant general. Upon electing to participate, the Missouri National Guard shall comply with the terms of an equitable sharing agreement and certificate of the federal asset forfeiture program, including, but not limited to, the United States Department of Justice Asset Forfeiture Program and the United States Department of the Treasury Asset Forfeiture Program, or any successor agreement or certification required by the federal government.
